Massachusetts legalized medical cannabis in 2012 via Question 3 and adult-use cannabis in 2016 through Question 4, with retail sales beginning November 20, 2018. The Cannabis Control Commission (CCC) regulates all licensed cannabis activity. The market generated over $1.65 billion in adult-use sales in 2025, setting an annual record. In 2026, the CCC approved social consumption licenses for the first time and proposed extending delivery license exclusivity for equity applicants through 2029. The legislature passed H.5350, restructuring the CCC into a three-member body and raising the ownership cap from three to six licenses. Oversupply concerns led to a cultivation license freeze starting June 2026. The state imposes a 10.75% excise tax plus 6.25% sales tax, and municipalities may levy an additional 3% local tax.
