Kansas permits an affirmative defense for possession of CBD oil with no more than 5% THC relative to CBD concentration under Claire and Lola's Law (SB 28, 2019, codified at K.S.A. 65-6235). The law covers patients with debilitating medical conditions causing serious impairment, including seizure disorders, who have a physician's written recommendation. Importantly, this is only an affirmative defense β patients can still be arrested and charged but may present the defense in court. Kansas has no medical marijuana program, no dispensaries, and no in-state production infrastructure. SB 294 (Medical Cannabis Act) was introduced in March 2025 but remains pending in the Senate Federal and State Affairs Committee. Kansas is one of only 11 states without a comprehensive medical cannabis law.
