Guam legalized adult-use cannabis through the Guam Cannabis Industry Act of 2019 (Public Law 35-5), making it one of the first US territories to permit recreational use. The Cannabis Control Board (CCB), housed within the Department of Revenue and Taxation, regulates the industry. In February 2026—seven years after legalization—the CCB approved Guam’s first two cannabis establishment licenses, marking the beginning of commercial operations. Additional dispensary licenses are expected through mid-2026. Adults 21+ may possess up to 1 ounce of cannabis and cultivate up to 6 plants for personal use. Medical cannabis has been available since the passage of the Joaquin (KC) Concepcion II Compassionate Cannabis Use Act of 2013. The prolonged gap between legalization and licensing was driven by regulatory delays, limited government resources, and the disruption of COVID-19.
