Indiana permits the sale and possession of hemp-derived CBD oil containing no more than 0.3% THC under SB 52 (2018), which expanded an earlier 2017 law (HB 1148) that restricted CBD use to patients with treatment-resistant seizures. SB 52 removed the seizure-only restriction and legalized CBD oil for any purpose, with mandatory testing and labeling requirements. SB 478 (2025) further tightened the regulatory framework with mandatory product registration, manufacturer permits, and child-resistant packaging. Indiana has no medical marijuana program, and all cannabis products exceeding 0.3% THC remain fully illegal. Every neighboring state (Illinois, Michigan, Ohio, Kentucky) now has some form of legal cannabis, increasing pressure on Indiana lawmakers.
