Nebraska voters approved Initiatives 437 and 438 in November 2024 with over 70% and 66% support respectively, legalizing medical cannabis possession (up to 5 ounces) and establishing a regulatory framework. The laws took effect December 12, 2024, making Nebraska the newest state to authorize medical cannabis. Implementation has been severely delayed: the Medical Cannabis Commission issued emergency rules that restrict inhaled cannabis and palatable edibles, and as of April 2026 the commission's formal regulations are awaiting Attorney General and Governor approval. Four cultivator licenses have been issued (1,250 plants each), but no dispensaries are operational and no physicians have yet issued recommendations, partly due to fear of federal retaliation. Patient access remains unavailable pending full regulatory implementation.
