Texas operates the Compassionate Use Program (CUP), established in 2015 and significantly expanded by HB 46 in June 2025. The 2025 expansion replaced the former 1% THC weight limit with a dose-based cap of 10 mg THC per dose and 1 gram THC per package, and added qualifying conditions including chronic pain, Crohn's disease, traumatic brain injury, and terminal illness. Permitted delivery methods now include lotions, patches, inhalers, and vaporizers, though smoking remains prohibited. The program is expanding from 3 to 15 licensed dispensing organizations, with satellite dispensaries permitted. By end of 2025, over 135,000 patients were registered in the CUP registry, a 32% year-over-year increase. The Texas Department of Public Safety oversees licensing and compliance.
