South Carolina permits epilepsy patients to use CBD oil with no more than 0.3% THC and at least 15% CBD under Julian's Law (S. 1035, 2014). The law provides a narrow affirmative defense and has no associated dispensary or production framework within the state. The SC Compassionate Care Act (SB 53), reintroduced by Sen. Tom Davis in January 2025, would establish a comprehensive medical cannabis program with 15 cultivator licenses, 30 processors, and 138 pharmacy licenses, but it remains pending in the Senate Committee on Medical Affairs as of April 2026. If passed, the program would permit vaporization but prohibit smoking and home cultivation. Hemp-derived CBD products with no more than 0.3% THC are broadly legal under federal hemp compliance.
