Alabama legalized medical cannabis in May 2021 through the Darren Wesley 'Ato' Hall Compassion Act (SB 46), though implementation has been significantly delayed by licensing disputes and litigation. The Alabama Medical Cannabis Commission (AMCC) oversees the program. After years of legal challenges, the first dispensary licenses were issued in January 2026, and the first dispensary—Callie's Apothecary in Montgomery—is expected to open on May 4, 2026. Four dispensary licensees plan to operate 12 locations across cities including Birmingham, Mobile, Daphne, Athens, and Talladega. Over 40 physicians have been approved to prescribe cannabis, though only 66 medical cannabis cards had been issued as of early April 2026. Alabama prohibits smokable flower; only non-smokable forms such as tablets, capsules, oils, and topicals are permitted.
